GENERAL PROVISIONS

The service provider declares that its data management activities - by adopting appropriate internal rules, technical and organizational measures - comply in all circumstances with REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL - (27 April 2016) on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter: Regulation) – as well as the provisions of Act CXII of 2011 on the right to informational self-determination and freedom of information (hereinafter: Infotv.).

Purpose of data processing

The purpose of data processing is to ensure the provision of services available on the website.

The Service Provider stores and uses the personal data provided by the Customer for the purpose of fulfilling orders, home delivery, enabling invoicing, and for customer service and service development.

The Customer acknowledges that the home delivery of ordered products is carried out by a contractual partner, and the Data Controller transmits the necessary data (name, address) for the performance of this service to the partner.

In the case of online bank card payments, the Service Provider does not gain access in any form to the Customer's card details or the underlying account details, number, or expiry date.

The Data Controller shall not use the personal data provided by the Customer for purposes other than those described above.

The Data Controller shall not disclose the personal data provided by the Customer to third parties or authorities - unless otherwise mandated by law.

Duration of data processing

The processing of personal data provided during purchase (with or without registration) begins with the purchase and lasts until the data is deleted by the Customer, but in any case for at least the expiry of the warranty period of the purchased product(s).

The Customer is entitled at any time to request information about the personal data relating to them processed by the Service Provider, and can modify them at any time on the Profile page. The User is also entitled to request the deletion of their data via the contact details provided in this point.

The Service Provider undertakes to ensure the security of data, and also takes technical measures to ensure that the collected, stored, and processed data are protected, and does everything possible to prevent their destruction, unauthorized use, and unauthorized alteration.

1. Data processing related to newsletter service

Natural persons registering for the newsletter service on the website can give their consent to the processing of their personal data by checking the relevant box. The data subject can unsubscribe from the newsletter at any time by using the "Unsubscribe" application in the newsletter, or by written statement, or by email, which means the withdrawal of consent.

Scope of personal data: name of the natural person (surname, first name), email address.

Purpose of personal data processing: sending newsletters regarding the Service Provider's products and services.

2. Social Media Guidelines / Data processing on the Company's Facebook, Instagram, and Tiktok pages

  • The Service Provider maintains social media pages to promote and popularize its products and services.
  • Questions and posts on the Service Provider's Facebook, Instagram, and Tiktok pages are not considered officially submitted complaints.
  • The Service Provider does not process personal data published by visitors on its Social Media pages.
  • Visitors are subject to the privacy and terms of service of the Social Media platforms: Facebook, Instagram, Tiktok.
  • In case of publishing illegal or offensive content, the Service Provider may exclude the data subject from members or delete their comment without prior notice.
  • The Service Provider is not responsible for content or comments that violate legal regulations published by Social Media users.
  • The Service Provider is not responsible for any errors, malfunctions, or problems arising from changes in the system's operation due to Facebook, Instagram, or Tiktok's operation.
3. Data processing in the Service Provider's webshop

Purchasing in the webshop operated by the Service Provider is considered a contract, in accordance with Section 13/A of Act CVIII of 2001 on certain issues of electronic commerce services and information society services, and Government Decree 45/2014. (II. 26.) on the detailed rules of contracts between consumers and businesses. In the case of webshop purchases, the legal basis for data processing is the contract.

For the purpose of establishing, defining the content, modifying, monitoring the performance of a contract for the provision of information society services, invoicing fees arising therefrom, and enforcing claims related thereto, the Service Provider may process the natural personal identification data and residential address necessary for identifying the buyer registering in the webshop, based on Section 13/A(1) of Act CVIII of 2001, and additionally, based on consent, their phone number, email address, bank account number, and online identifier.

For billing purposes, the Service Provider may process natural personal identification data, residential address, and data relating to the time, duration, and place of use of the information society service, based on Section 13/A(2) of Act CVIII of 2001.

Recipients of personal data, or categories of recipients: employees of the Service Provider performing customer service and marketing-related tasks, as data processors, employees of the company performing the Service Provider's taxation and accounting tasks for the purpose of fulfilling tax and accounting obligations, employees of the Service Provider's IT service provider for the purpose of fulfilling hosting services, and employees of the courier service regarding delivery data (name, address, phone number).

Duration of personal data processing: until the registration / service exists, or until the data subject's consent is withdrawn (deletion request), in case of purchase, for 5 years following the year of purchase.

WEBSHOP USAGE

Using the webshop managed on vitezkurtos.hu is not necessarily subject to registration. Purchases can be made with or without registration.

The Customer acknowledges and accepts that the personal data provided during registration and/or purchase will be processed by the Service Provider, as Data Controller, in the manner described in the Privacy Statement included in this information notice.

The prices indicated for the products are gross prices, expressed in Hungarian Forints.

For the products we sell – where applicable and required by law – instructions for use are enclosed with the goods. If you accidentally do not receive the instructions for use with the goods, please notify our customer service immediately – before using the goods – and we will provide them.

If you need more information than what is published on the website regarding the quality, basic properties, use, or usability of any product on the website, please contact our customer service.

If you have any questions about the product before purchasing, our customer service is at your disposal.

Order

Products placed in the cart can be removed from the cart or their quantity can be changed as desired until the order is confirmed.

The personal data required to place an order depend on the selected delivery and payment methods. While for personal pickup and cash payment only contact (email, phone number) and billing details are mandatory, for delivery the delivery address is essential.

After selecting the shipping and payment methods and entering the requested data, the order can be placed under the Confirmation tab, which will be recorded. If you have chosen the bank card payment option, you can then pay on the Bank's online payment page.

Confirmation

After sending the order, the system sends an automatic confirmation email to the Customer, which contains all data and information related to the order. If the Customer finds an error in the confirmation email, they should immediately notify the Service Provider to avoid incorrect fulfillment. The Service Provider is not liable for any delivery delays or other problems/errors attributable to data incorrectly and/or inaccurately provided by the Customer.

Shipping terms, fees

Ordered products can only be picked up in person in Budapest, at the locations listed below, during the specified opening hours:

Weekdays between 9:00 - 17:00

In case of personal pickup, there are no additional costs beyond the price of the ordered products.

For home delivery, the following gross delivery fee is payable in addition to the total value of the ordered products:

NATIONAL HOME DELIVERY FROM HUF 1,990!

(0-10 kg HUF 1990,

10-20 kg HUF 2990,

20-30 kg HUF 4980

and so on.. )

For delivery and cash payment, a cash on delivery fee of HUF 490 is charged.

This fee is not charged for personal pickup.

Delivery of ordered products will take place within 2 working days after the order (or receipt of payment in case of bank transfer).**

* For chimney cake home delivery, the delivery fee is HUF 2990, even if other products are ordered along with the chimney cakes.

** For chimney cake home delivery orders (only within Budapest), delivery will take place at the requested and confirmed time. If you order other products along with the chimney cake in the same order, they will also be delivered together with the cakes.

Payment terms:

Payment for purchased goods can be made by:

  • cash (on personal pickup or cash on delivery)
  • online, by bank card payment.
  • Our webshop provides card acceptance through Shopify Payments, via its secure, encrypted payment system.
  • When paying by bank card, payment is made directly on the page operated by Shopify Payments, which operates according to the rules and security regulations (PCI DSS) of international card companies, and not on the webshop page.
  • The online store does not possess, and cannot access, your card details or the underlying account details, number, or expiry date in any form.
You can pay with the following card types in our webshop:

  • other card types supported by Shopify Payments

To further enhance the security of online card acceptance, Shopify Payments supports 3D Secure (3DS) authentication. The essence of this service is that the bank issuing the card used for payment provides an additional identification option to the cardholder, which is checked during the transaction and unequivocally identifies the person using the card.

If 3D Secure service is available at your card-issuing bank and you use it, before finalizing the payment, you will be redirected to your card-issuing bank's identification interface, where you must complete the identification process. After successful identification, the payment transaction continues.

After successful payment, you will receive a notification of the transaction's success and will be redirected to the webshop interface. If you cannot complete the identification, the transaction will end unsuccessfully.

Right of Withdrawal

The Customer may withdraw from the contract without justification within eight working days of receiving the product, provided that the product has not yet been used. After use, the rules of warranty and guarantee apply.
